Revised Modification to Community Decision Making & Review Process (CDMRP) Hearing

The Kahnawą:ke Legislative Commission (KLC) wishes to inform the community that although the process for holding hearings to create or amend laws through the Community Decision Making and Review Process (CDMRP) had been modified in January 2024, it required clarification and has since undergone further revision.

The previously modified process is as follows, with a change to the last section:

The Technical Drafting Committee (TDC) will use a pre-registration method to register at least ten (10) participants, subject to a registration deadline. Food and refreshments will be offered to participants. Non-registered participants will also still be welcome and encouraged to attend the hearing. If after 15 minutes from the scheduled start time of that hearing there are less than ten (10) participants in attendance the hearing will be postponed. Those participants in attendance will however have an opportunity to provide input on the draft law for the TDC’s consideration. A second attempt at holding the hearing will be made.

The hearing will then be scheduled for a second time with the same pre-registration requirement as the first attempt. However, if there are less than ten (10) registered participants the hearing date will be cancelled altogether.

This formerly read, “No further attempts at holding the hearing will be made. The draft law or suggested amendments will be considered as acceptable to the community. The community will be informed of the attempts made to hold a hearing and the law will proceed to the next step in the process.”

It has now been modified to read, “The draft law or suggested amendments will be forwarded to the KLC with a recommendation from the TDC for a decision on next steps. The KLC will direct whether the draft Law or amendments is/are deemed acceptable at that point or if additional measures need to be taken. The community will be informed of the attempts to hold a Hearing and the KLC’s decision, including its rationale, on the next steps.”
